Discharge of student loans in bankruptcy under scrutiny by U.S. DOE

Last month, we blogged about the challenge of getting student loans discharged in bankruptcy. In that post, we talked about the legal standard of "undue hardship" that must be met in New Mexico to have your student loans discharged in bankruptcy.

What is the automatic stay in bankruptcy?

When a debtor files a petition for bankruptcy, an automatic stay of all collection activities against the debtor takes immediate effect. This is a broad, temporary protection for the debtor against legal action to collect the debtor's money or property to satisfy debts.

Are student loans negatively affecting your standard of living?

Many New Mexicans face daunting student loan payments each month that restrict their abilities to buy homes and vehicles as well as, ironically, to begin to put money away for their own children's future college educations. While the federal government and some private lenders offer repayment plans based on income that reduce monthly payments as well as other options like deferment or forbearance, some student loan debtors are either not eligible for relief or even with it, the payments are still very difficult.

She continued, however, with a concern that the recent federal decision to remove the guaranty of net neutrality could slow the upward "momentum" of New Mexico tech businesses.

Bankruptcy issues for New Mexico medical-marijuana businesses

Since 2007, New Mexico has allowed legal, regulated use of cannabis to treat certain medical conditions. As of October, the state was home to an average of about 44,000 active medical marijuana patients, with the highest numbers using it to alleviate the symptoms of post-traumatic stress disorder or PTSD and severe, chronic pain, with cancer a distant third, reports the New Mexico Department of Health.

Time-barred debts and bankruptcy

The U.S. Supreme Court recently issued a controversial decision about creditors filing claims in bankruptcy proceedings after the legal deadlines have passed to collect those debts in lawsuits. This holding may affect our clients on both sides of the issue: creditors seeking to collect on older debts as well as consumers filing bankruptcy for relief from crushing debts, some of which may have become stale.

Brick-and-mortar retailers in the age of e-commerce

Retail businesses that operate largely in traditional malls and standalone stores, rather than growing their online presence, may find it more and more difficult to compete. After all, the costs of major real estate holdings and commercial leases can drive up the retail prices they must offer, lessening competitive strength.
